These General Terms and Conditions of Sale (GTCS) govern the sale of products and services offered by the company Les Petits Morain under the trading name Mes Jolis Gâteaux (hereinafter referred to as “the Seller”) to its customers (hereinafter referred to as “the Client”). They apply to all orders placed in-store, by phone, by email, or through the website.
The products sold are handcrafted pastries. The photographs presented are non-contractual. As all products are handmade, variations may occur.
All confirmed orders are final and cannot be cancelled. Full payment is required to confirm the order. No deposit will be accepted. Orders must be paid in full at least 15 days before the pickup or delivery date. If full payment is not received within this timeframe, the order will not be validated and therefore not produced.
Any order that has been placed and paid is considered firm and final. No last-minute modifications (change in design, text, colour, date, or any other adjustments) will be accepted once payment has been validated. Clients are therefore encouraged to carefully review their order before proceeding with payment.
All figurines created by Mes Jolis Gâteaux (including when ordering figurines alone, without a cake) are original creations and remain the exclusive intellectual property of SARL Les Petits Morain, trading as Mes Jolis Gâteaux. Any reproduction, distribution, or commercial use, even partial, is strictly prohibited without prior written consent.
We strive to accommodate all requests, including last-minute ones. However, orders confirmed within a short timeframe (3 to 7 days before pickup or delivery) are accepted on an exceptional basis, depending on our availability and goodwill.
In such cases, last-minute payment may be authorized, but only with our prior agreement. We reserve the right to refuse any order not confirmed and paid within the usual deadlines.
Prices are quoted in euros, including VAT. The Seller reserves the right to modify its prices at any time, but products will be invoiced based on the current rate at the time of ordering.

Products are to be picked up in-store during business hours, unless otherwise agreed. Delivery is available under certain conditions (geographical zone, order minimum, delivery fee). Any delivery timeframes are indicative only.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to perishable goods (pastries). All confirmed orders are final.
Cakes should be consumed within 2 to 3 days after pickup. They must be stored in a room at ambient temperature (16–22°C) and must not be refrigerated, as refrigeration may cause the fondant to melt. For transport, it is recommended to use an air-conditioned vehicle. Cakes should always be kept flat, supported from the bottom, and handled with care.
Before consumption, all non-edible decorations must be removed. Caution: some sugar paste decorations may harden and pose a risk of breaking or cutting. Please supervise children. Some cakes contain wooden dowels to ensure structural integrity—these must be identified and removed before serving.
Any complaints must be made at the time of pickup or delivery. No complaints will be accepted thereafter. In the event of a dispute, an amicable solution will be sought as a priority.
The Seller cannot be held liable for any indirect damage resulting from the use or consumption of the products. Products must be stored and handled according to the instructions provided.
All creations (cake designs, models, photographs) remain the property of SARL Les Petits Morain under the trading name Mes Jolis Gâteaux. Any reproduction or use without prior consent is prohibited.
The data collected is used solely for order processing and customer relations. In accordance with the French Data Protection Act, the Client has the right to access, modify, and delete their personal data.
These GTCS are governed by French law. In the event of a dispute, the competent court will be the Commercial Court of Nanterre
